Data Deletion And Retention Policy
1. The Basics
- This policy aims to provide guidelines for the retention and deletion of Customer Data. “Customer Data” means any information or data that is made available or provided by the customer or its users, survey respondents to SurveySparrow or its representatives, including but not limited to survey responses, data, feedback, and other information and data related to the Services.
- SurveySparrow’s Data Deletion & Retention Policy (“Data Deletion & Retention Policy ”) describes how our Customer’s Data is deleted or retained (for a period of time) in connection with the cancellation, termination of an account.
- This Data Deletion & Retention Policy does not apply to data that resides in a SurveySparrow product or service that is in a beta, testing or early access program.
2. Deletion or return of customer data
- Upon termination or cancellation of the account, SurveySparrow shall, no later than 30 days, at the request of the customer, either delete or return the Customer Data (including its copies, if any) that is in its possession or control except where such data that is required by applicable law to be retained either in whole or in part, or otherwise that are archived on back up systems which SurveySparrow shall securely isolate, protect from any further processing and eventually delete.
- When an account is deleted, all data associated with the account is destroyed immediately. If it is a HIPAA enabled account we will immediately delete or destroy the PHI received, provided or processed pursuant to signing a BAA with You.
3.Retention of customer data
- SurveySparrow stores Customer Data with reference to your service account. This may include personal information, survey data and other details that you enter into the app from time to time. SurveySparrow will retain your personal information as long as you have an account with us in order to maintain and expand our relationship with you and in order to have proof and evidence concerning our relationship with you. Please note that except as required by applicable law or our specific agreements with you, we shall not have any obligation to retain your data for any particular period.
- Upon termination or expiry of your account, we will delete all personal information including any copies thereof within your SurveySparrow account. If it is a HIPAA enabled account we will immediately delete or destroy the PHI received, provided or processed pursuant to signing a BAA with you. In case, we are unable to delete your personal information due to technical or other reasons, SurveySparrow will continue to apply measures to ensure that your personal information is blocked from any further processing until deletion is possible. This excludes the data that we are required to retain for legal and regulatory requirements.
4. Migration
- In certain instances, the migration of Customer Data to another data center may be required. In this process, a copy of your Customer Data will be created for the purposes of assuring that it has been fully migrated to another data center. After the migration process has been completed and confirmed, the deletion of the copy of your Customer Data in the former data center facility will commence under this policy. Customers should expect that migrations will likely require a scheduled downtime.
5. Policy Limitations
- This Data Deletion & Retention Policy is applicable only to the specific Customer Data.
- SurveySparrow reserves the right not to adhere to this Data Deletion & Retention Policy when deleting Customer Data in cases where SurveySparrow terminates an account for violation of our Privacy Policy or Terms of Service Agreement.
6. Expedited customer data deletion
- SurveySparrow does not offer expedited deletion of Customer Data. Except as otherwise agreed in writing,, all Customer Data is deleted according to the timelines presented above.
